The African Action Congress (AAC) has asked the Federal High Court in Abuja to determine whether President Bola Tinubu complied with the constitutional requirements governing presidential absence from Nigeria during his ongoing Europe trip.
The party filed an originating summons on Monday, naming Tinubu, the Attorney General of the Federation, the Senate President, the Speaker of the House of Representatives and the National Assembly as defendants.
The suit, marked FHC/ABJ/CS/2358/2026, alleges that Tinubu left Nigeria for Europe on August 30, 2026, without transmitting a written declaration to the leaders of the National Assembly.
The AAC is asking the court to determine whether Section 145(1) of the 1999 Constitution requires the President to transmit such a declaration before proceeding on vacation, irrespective of its duration.
It is also challenging the alleged failure of the National Assembly to convene and pass a resolution allowing Vice-President Kashim Shettima to act as President after Tinubu had spent more than 21 days away.
The party wants the court to determine whether the National Assembly breached its constitutional duty under Section 145(2) by failing to take such action.
The AAC is further seeking an order restraining Tinubu from embarking on future vacations within or outside Nigeria without first transmitting the required written declaration to the Senate President and Speaker of the House of Representatives.
The case was filed by Inibehe Effiong of Inibehe Effiong Chambers on behalf of the AAC.
The defendants have been directed to enter an appearance within 30 days of being served with the originating summons.
No hearing date has been fixed.
